Legal
Terms and Conditions
These terms cover using this website and working with Mavorena. They are written to be understandable rather than intimidating.
1. Acceptance
By using this website you agree to these terms. If you engage Mavorena Digital Strategies for services, a separate written proposal or agreement will set out the scope, fees and schedule; where it conflicts with these terms, that signed agreement takes precedence.
2. Use of this website
You agree not to:
- Attempt to disrupt, overload, probe or gain unauthorised access to the site or its infrastructure.
- Submit false information, malicious code, or automated bulk submissions through our forms.
- Copy, scrape or republish the site's design, code or written content without permission.
3. Content and portfolio disclosures
Portfolio items presented on this website are original fictional concepts created by Mavorena to demonstrate design capability. They are labelled as concepts and do not represent real clients, engagements or endorsements. Written guidance in our insights articles is general information, not legal, financial or professional advice.
Nothing on this website is a guarantee of specific business results, search rankings, traffic or revenue.
4. Engagements and proposals
Submitting an inquiry does not create a contract. A project begins when a written proposal is accepted by both parties and any required initial payment is received. Proposals are valid for 30 days unless stated otherwise.
5. Client responsibilities
- Provide accurate business information, and content or approvals within agreed timeframes.
- Hold the necessary rights to any text, logos, images or other material you supply to us.
- Nominate a single decision-maker for approvals to keep the project moving.
- Maintain your own domain registration, hosting accounts and third-party subscriptions unless we have agreed to manage them.
6. Fees and payment
Fees, instalments and any ongoing charges are stated in the proposal. Unless agreed otherwise, an initial payment is due before work begins and remaining amounts are due at the milestones described. Invoices are payable within the period stated on the invoice. Late payment may pause work. Taxes, and third-party costs such as domains, hosting, licensed fonts, stock assets or paid tools, are your responsibility unless the proposal says they are included.
7. Revisions and scope
Each proposal includes a defined number of revision rounds at the stages where feedback is most useful. Requests that add pages, features or new directions after approval are treated as additional scope and quoted separately before any work is done, so nothing is billed by surprise.
8. Timelines
Estimated timelines assume timely feedback and content. Delays in approvals, content or third-party access will move the schedule accordingly. If a project stalls for more than 60 days without client response, we may close it and require a restart fee to resume.
9. Ownership and licences
- On full payment, you own the final delivered website design and the content you supplied.
- Mavorena retains ownership of underlying tools, internal libraries, working files and unused concepts.
- Third-party assets such as fonts, plugins or stock media remain under their own licences, which pass to you as permitted.
- Unless you ask us not to, we may show the finished work in our portfolio and describe the work performed.
10. Third-party services
Projects often rely on external providers for hosting, email, analytics, payments or booking. Those services are governed by their own terms, and we are not responsible for their availability, pricing changes or data practices.
11. Warranties and disclaimers
We warrant that services will be performed with reasonable skill and care. Following launch, we will correct defects in our own work that are reported within the support period stated in your proposal. Beyond that, this website and our services are provided "as is" without further warranties, to the fullest extent permitted by law.
12. Limitation of liability
To the extent permitted by law, Mavorena Digital Strategies is not liable for indirect, incidental or consequential losses, including lost profits, lost revenue, lost data or business interruption. Our total aggregate liability arising from an engagement is limited to the fees you paid for that engagement. Nothing in these terms excludes liability that cannot lawfully be excluded.
13. Termination
Either party may end an engagement in writing. If you cancel, fees for work already completed remain payable and any unearned balance is returned. If we must withdraw — for example where the work falls outside our expertise or communication has broken down — we will hand over completed work and refund any unearned amount.
14. Governing law
These terms are governed by the laws of the jurisdiction where Mavorena is established, and disputes will be handled by the courts of that location. Before formal action, both parties agree to attempt a good-faith resolution by direct discussion.
15. Changes to these terms
We may update these terms; the version published here with its last-updated date applies to new inquiries and engagements. Existing signed agreements are not changed retroactively.
